1. Introduction

Welcome to e-mate. These Terms of Service ("Terms") govern your use of our website and services. By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the service.

2. Definitions

• Service refers to the website operated by e-mate.
• User refers to individuals who register on our platform to book sessions with experts.
• Expert refers to individuals who register on our platform to offer their expertise and services.
• Session refers to a scheduled meeting between a User and an Expert.
• Content refers to text, images, videos, audio, or other material that can be uploaded, posted, or shared on our platform.

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our service.

You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Expert Services

Experts on our platform are independent contractors and not employees of e-mate. We do not guarantee the quality, accuracy, or reliability of any advice or services provided by Experts.

Experts are responsible for:

• Providing accurate information about their expertise and qualifications
• Being available for scheduled sessions
• Providing professional and respectful service to Users
• Complying with all applicable laws and regulations

We reserve the right to remove any Expert from our platform at our sole discretion.

5. Booking and Payments

Users can book sessions with Experts based on their availability. Payment must be made at the time of booking.

Our cancellation policy is as follows:

• Full refund if cancelled more than 24 hours before the scheduled session
• 50% refund if cancelled between 12-24 hours before the scheduled session
• No refund if cancelled less than 12 hours before the scheduled session

If an Expert cancels a session, the User will receive a full refund or can reschedule at their discretion.

We charge a platform fee of 10% on all transactions. Experts receive 90% of the amount paid by Users.

6. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of e-mate and its licensors. The service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Users and Experts retain ownership of any content they create and share on our platform. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute it in any media.

7. Prohibited Activities

You may not engage in any of the following prohibited activities:

• Using the service for any illegal purpose or in violation of any local, state, national, or international law
• Harassing, abusing, or harming another person
• Impersonating someone else or misrepresenting your affiliation with a person or entity
• Interfering with or disrupting the service or servers or networks connected to the service
• Attempting to bypass any measures of the service designed to prevent or restrict access
• Using the service to advertise or offer to sell goods and services unrelated to our platform

8. Limitation of Liability

In no event shall e-mate, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the service
• Any conduct or content of any third party on the service
• Any content obtained from the service
• Unauthorized access, use or alteration of your transmissions or content

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service or contact us to request account deletion.
